These Terms & Conditions govern use of the Phipps Construction website only. Separate written contracts govern individual construction projects. Nothing in these Terms replaces or supersedes a signed project contract between Phipps Construction LLC and a client.

1. Acceptance of Terms

By accessing or using the website located at jphippsconstruction.com (the "Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Site. These Terms apply to all visitors, users, and anyone else who accesses the Site.

Phipps Construction LLC reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms.

2. About Phipps Construction

Phipps Construction LLC is a Class A licensed residential and commercial general contractor registered in the Commonwealth of Virginia. We operate primarily in Virginia Beach, Chesapeake, and Norfolk, Virginia.

The Site is provided for informational and lead generation purposes only. Browsing the Site, submitting a quote request, or contacting us through the Site does not create a contractor-client relationship. A formal contractor-client relationship is established only upon execution of a written contract signed by both parties.

Submitting a quote request through the Site does not guarantee that Phipps Construction will take on your project or provide a specific price. All quotes and estimates provided verbally, by email, or through our website are preliminary in nature and subject to:

An in-person or virtual site assessment
Review of applicable permits, codes, and site conditions
Final written proposal and scope of work approval by both parties

Phipps Construction reserves the right to decline any project at its sole discretion. Submission of a quote request through the Site does not constitute an offer or obligation on the part of Phipps Construction.

We will not include personally identifying information (such as addresses or full names) without explicit permission.

You agree to defend, indemnify, and hold harmless Phipps Construction LLC, its owner, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from your use of the Site, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms or the use of this Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Virginia Beach, Virginia.

Before initiating any legal proceeding, both parties agree to attempt to resolve disputes informally by contacting Phipps Construction directly and allowing a reasonable period of not less than 30 days to attempt resolution.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any written project contracts, constitute the entire agreement between you and Phipps Construction LLC with respect to your use of this Site and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
